Terms & Conditions

Please read these terms carefully before using PACU services. By accessing our platform, you agree to be bound by these terms.

1. Agreement to Terms

By accessing or using the website at pharmacyacute.com (the “Site”) and any related services provided by Pharmacy & Acute Care University LLC (“PACU,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not access or use our services.

These Terms constitute a legally binding agreement between you and PACU. We encourage you to read them carefully before creating an account or purchasing any subscription.


2. Description of Services

PACU provides online pharmacy education designed for clinical professionals. Our services include, but are not limited to:

  • PACULit — Curated pharmacy literature reviews with continuing education (CE) credit opportunities
  • PACU Core — A comprehensive course library and clinical reference materials
  • PACU Premium — Board certification preparation for BCPS, BCCCP, and BCEMP examinations
  • PACUPrep — Question banks, practice exams, and study guides
  • Community Forums — Professional networking and peer discussion
  • Live Events — Webinars, seminars, and continuing education workshops

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice to active subscribers.


3. Account Registration

To access certain features of the Site, you must create an account. By registering, you represent and warrant that:

  • You are at least 18 years of age.
  • All information you provide during registration is accurate, current, and complete.
  • You will maintain and promptly update your account information to keep it accurate.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.

You must notify us immediately at [email protected] if you suspect any unauthorized use of your account. PACU is not liable for any loss or damage arising from your failure to protect your account credentials.


4. Subscription Plans & Billing

4.1 Free Trial

PACU may offer a 7-day free trial for new subscribers. A valid credit card is required to initiate the trial. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid plan, and you will be charged at the applicable rate.

4.2 Recurring Billing

Subscriptions are available on monthly and annual billing cycles. By subscribing, you authorize PACU to charge your designated payment method on a recurring basis at the beginning of each billing cycle.

4.3 Auto-Renewal

All subscriptions automatically renew at the end of each billing period unless you cancel prior to the renewal date. You may cancel auto-renewal at any time through your account settings.

4.4 Price Changes

PACU reserves the right to adjust subscription pricing. We will provide at least 30 days’ written notice before any price increase takes effect. Continued use of the service after a price change constitutes acceptance of the new pricing.

4.5 PACU Premium Deposits

Certain Premium board preparation programs may require a deposit upon enrollment. Deposits are refundable upon successful completion of the program commitment period, subject to the terms outlined at the time of enrollment.


5. Cancellation & Refund Policy

5.1 Cancellation

You may cancel your subscription at any time before the start of your next billing cycle. Cancellation takes effect at the end of the current paid period, and you will retain access to services until that date.

5.2 Monthly Plans

No refunds are issued for partial months. Once a monthly billing cycle has begun, you will have access through the remainder of that cycle, but no pro-rated refund will be provided.

5.3 Annual Plans

Annual subscribers who cancel within the first 30 days of their subscription are eligible for a pro-rated refund of the unused portion. After 30 days, no refunds are available for annual plans.

5.4 PACU Premium Deposits

Deposits for PACU Premium programs are refundable upon successful completion of the commitment period as defined in your enrollment agreement. Early withdrawal may result in forfeiture of the deposit.

5.5 Pass Guarantee

PACU Premium subscribers may be eligible for the Pass Guarantee program. Specific terms, conditions, and eligibility requirements for the Pass Guarantee are outlined separately at the time of enrollment and are available upon request.


6. Continuing Education (CE) Credits

PACU offers continuing education credits through accredited programming. By participating in CE activities, you acknowledge and agree to the following:

  • ACPE Accreditation: CE activities are accredited in accordance with the Accreditation Council for Pharmacy Education (ACPE) standards. Accreditation status and details are provided with each eligible activity.
  • User Responsibility: It is your sole responsibility to track your CE requirements, ensure completion of activities, and verify that credits meet the requirements of your state board of pharmacy or credentialing body.
  • Non-Transferable: CE credits are awarded to the individual who completes the activity and cannot be transferred to another person.
  • State-Specific Requirements: CE requirements vary by state. PACU does not guarantee that all CE activities will satisfy the specific requirements of your jurisdiction. You are responsible for confirming compliance with your state board.

7. Intellectual Property

7.1 Ownership

All content on the Site — including but not limited to text, graphics, logos, images, audio, video, course materials, question banks, software, and design — is the property of Pharmacy & Acute Care University LLC or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.

7.2 Permitted Use

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the content for personal, non-commercial educational purposes only.

7.3 Restrictions

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without prior written permission from PACU.

7.4 User-Generated Content

By submitting content to forums, discussions, or other interactive features, you grant PACU a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content in connection with operating and improving our services.


8. Acceptable Use

You agree not to engage in any of the following prohibited activities:

  • Account Sharing: Sharing your login credentials or allowing others to access your account is strictly prohibited. Each subscription is for individual use only.
  • Automated Access: Using bots, scrapers, or any automated means to access, download, or extract content from the Site is prohibited.
  • Redistribution: Copying, redistributing, selling, or sharing course materials, question banks, study guides, or any other PACU content is prohibited.
  • Misrepresentation: Misrepresenting your credentials, professional status, or affiliation in connection with PACU services is prohibited.
  • Interference: Attempting to interfere with, compromise, or disrupt the Site or its servers, networks, or security features is prohibited.

Violation of these terms may result in immediate account suspension or termination without refund.


9. Disclaimer of Warranties

PACU services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, PACU disclaims all warranties, express or implied, including but not limited to:

  • Educational Purpose: All content is provided for educational and informational purposes only. PACU content does not constitute medical advice, and you should not rely on it as a substitute for professional clinical judgment.
  • No Guarantee of Results: While PACU strives to provide high-quality exam preparation, we do not guarantee that you will pass any certification exam. The Pass Guarantee program, where offered, has its own separate and specific terms.
  • Accuracy: Although we make every effort to ensure accuracy, content may contain errors or become outdated. PACU is not responsible for any inaccuracies.
  • Availability: We do not warrant uninterrupted or error-free access to the Site or services.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Pharmacy & Acute Care University LLC, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the services.

In no event shall PACU’s total aggregate liability to you for all claims arising out of or related to these Terms or the services exceed the total amount of subscription fees you have paid to PACU during the twelve (12) months immediately preceding the event giving rise to the claim.


11. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the practices described in the Privacy Policy.


12. Modifications to Terms

PACU reserves the right to modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on the Site and updating the “Effective” date at the top of this page. We may also notify you via email for significant changes.

Your continued use of the Site or services after the revised Terms have been posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue use of our services.


13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in York County, South Carolina, and you consent to the personal jurisdiction of such courts.
